Six women from five prefectures, including Tokyo and Kanagawa, filed a lawsuit against a man
from Saitama who filmed and posted videos in which he committed violence against cats. The
women claimed that the animal abuse video caused emotional distress and demanded
compensatory damages of 6,600,000 yen($49,000) while bringing a case before the Saitama
District Court. During the first oral pleading, the defendant submitted a reply stating that he was
not accountable for the damages caused.
According to the petition, during the period between March 2016 and April 2017, the defendant
repeatedly committed violence against cats—such as pouring boiling water, throwing
firecrackers, and exposing them to a gas burner—while filming the details of the incident. The
videos were partially posted on the internet and made visible to many people.
The six plaintiffs, who have been actively involved in animal rights protection, found the videos
on social media platforms such as Twitter and Youtube. They have claimed that the malicious
content caused psychological trauma, eventually leading some audiences to develop posttraumatic stress disorder (PTSD).
In December 2017, the Tokyo district court convicted the defendant of offences under the
animal protection law with a suspended sentence for killing and maiming 13 cats.
As for offences against animals, the penalties for killing or maiming animals were strengthened
under the amended animal cruelty act, which has been in place since last June. On the other
hand, a prohibition on the distribution and circulation of animal crush videos has yet to be
introduced. The plaintiffs stated in the class action lawsuit, "We hope this case encourages
prevention and restriction of animal crush videos, which remain unmonitored today."
Katsuhiro Ueda, a lawyer with multitudes of experience in animal protection, stated: "Distributing
videos of brutal criminal conduct that causes emotional distress to many exceeds the tolerance
for freedom of expression. If these animal cruelty videos continue to be unpoliced, illegal
activities may be provoked further—hence the need for a legal restriction."

インターネット上で拡散された猫の虐待動画を見て精神的苦痛を受けたと
して、東京、神奈川など五都府県に住む女性六人が、動画を撮影・投稿した
埼玉県内の男性に六百六十万円の損害賠償を求め、さいたま地裁に提訴
したことが分かった。十七日に第一回口頭弁論があり、男性は「自らに責任
はない」とする趣旨の答弁書を提出した。
訴状によると、男性は二〇一六年三月～十七年四月、猫に熱湯や爆竹を
浴びせたりガスバーナーであぶったりする虐待行為を繰り返し、動画で撮
影。一部をネット上に投稿し、多くの人が見られる状態にした。
動物愛護の活動に関わる原告六人は、この動画をツイッターやユーチュー
ブなどの会員制交流サイト（SNS）で目にし、残酷な内容のため心理的外傷
後ストレス障害（PTSD）やうつ病と診断された人もいるとしている。
被告の男性は猫十三匹を殺傷した動物愛護法違反の罪で、十七年十二
月に東京地裁で執行猶予付きの有罪判決を受けている。
動物虐待を巡っては、昨年六月に施行された改正動物愛護法で、殺傷し
た場合の罰則が強化された。一方で動画の公開や流通を禁止する法律は
ない。原告側は今回の集団訴訟を通じて「虐待動画が事実上野放しにされ
ている現状への抑止力や、規制に向けた後押しになれば」としている。
動物愛護の問題に詳しい植田勝博弁護士（大阪弁護士会）は「残酷な犯
罪行為を動画で垂れ流し、嫌悪感を与えるのは社会のルール違反で、表現
の自由を超えている。放置すれば犯罪を誘発しかねず、法律などで規制す
べきだ」と指摘している。
